Korea Kumho Petrochemical imports certain tire production chemicals into the U.S. The investigation started in January 2005, based on Flexys’ claims that KKPC violated some of its process patents.
KKPC is part of the Kumho Asiana Group, which includes Kumho Tire Co. and its subsidiaries.
The final decision was issued by the ITC on July 13, according to KKPC.
"We are pleased that the full International Trade Commission has now confirmed the Administrative Patent Judge’s prior decision that KKPC did not violate the ITC’s unfair trade practice laws," said Mi-Hyung Kim, LLPC executive vice president and general counsel. "With the termination of the ITC’s investigation in KKPC’s favor, KKPC can continue its business of producing high-quality tire chemicals without the uncertainty of an ongoing ITC investigation."
