They allege Tirecraft dismissed them without cause, notice, or severance when it went into receivership last June. The directors knew or should have known that the company was unable to meet its debt obligations, including amounts due to employees, a statement of claim filed in Edmonton Court of Queen’s Bench says.
The 11 plaintiffs, all co-owners of the stores with Tirecraft, are seeking $250,000 each in lost wages, bonuses and vacation pay. They include Mario Scarpelli and Pat Jurasek, who ran the Tirecraft Truck Centre in Edmonton, and Pat Finstad, manager of the St. Albert operation.
Allegations made in a statement of claim have not been proven in court.
