China has appealed the World Trade Organization’s December 2010 ruling that upheld the three-year tiered added tariff placed on consumer tires exported from China to the U.S.
China insists the U.S. violated international trade rules when it imposed the tariffs, a WTO spokesman said.
The U.S. has until May 30 to lodge a counter appeal over its rights to tax Chinese tires.
A legal panel at the WTO ruled in December that the U.S. was within its rights to add the 35%/30%/25% tariff to the tires under WTO provisions that allow countries to protect local industries.
After the action of United Steelworkers, which brought the anti-dumping complaint in April 2009, the tariff was first applied in September 2009, and has dropped to 30% as of Sept. 26, 2010. It is scheduled to completely expire in September 2012.
