The U.S. District Court for the District of Minnesota ruled that Gaither Tool Co.’s U.S. Bead Bazooka line of tire bead seaters infringes on Tire Service Equipment Manufacturing Co.’s U.S. patent for its Cheetah Cannon product.
The court has issued a permanent injunction that keeps Gaither from “directly or indirectly making, using, selling, offering for sale or importing or causing or inducing others to make, use, sell, offer to sell, or import” all of Gaither’s Bead Bazooka products in the U.S. for the term of TSISSG’s U.S. Patent No. 6,179,033. The injunction applies to Gaither’s entire line of Bead Bazooka products, including model numbers BB6L, BB9L and BB12L.
According the Paragraph 5 of the judgment, the “injunction does not apply to distributors, customers or end-users that received and paid for one or more Bead Bazooka Products prior to January 22, 2016, which shall have a limited license to use or resell said Bead Bazooka Products.”
This is the second time Gaither has been required to remove a product that infringed on a Tire Service Equipment Manufacturing patent in the U.S.
