A customer is suing a Sears Auto Center in Louisiana for allegedly not putting all of her tire’s lug nuts back on after replacing tires. The customer alleges that this resulted in one of the wheels falling off the car, causing injuries to the vehicle’s occupants.
The suit is being filed against Sears, Roebuck and Co., Sears Auto Center and two employees in a Louisiana state court.
The plaintiffs allege that on June 30, 2014, Patricia Herrero had her 1996 Toyota Avalon serviced at a Sears Auto Center where all four tires were replaced on the vehicle, which was also aligned. Less than a week later, Herrero asserts she had only driven her car a few miles with her daughter and mother when the rear left tire came off the vehicle, causing her to lose control of the car.
The plaintiffs allege a mechanic who was following close behind them picked up their tire and found only one lug nut had been holding the tire on and it had been loose. According to court documents, when the mechanic inspected the three other tires, he allegedly found each tire was missing a lug nut.
The plaintiffs said they were all injured in the incident.
The defendant is accused of negligence, breach of duty, breach of contract and violation of state law.
